The Classification Work That Comes Before Rollout

Microsoft Copilot for law firms inherits the tenant’s existing permissions. Every overshared SharePoint site, every stale guest link, and every matter site that was opened to the whole firm for convenience years ago becomes reachable through Copilot the moment it turns on. The classification layer runs first: sensitivity labels on matter files through Microsoft Purview, permission cleanup so each matter is scoped to the attorneys and staff actually working it, and DLP policies that stop labeled content from reaching unapproved AI. Ethical Walls Have to Exist in the Tenant

Conflict screens and ethical walls are technology controls as much as policy. Firms running ethical walls need to enforce them through Entra ID security groups, SharePoint permissions scoped by matter, and sensitivity labels, and close out matter-site access when a matter ends. Which Staff Should Get Licenses First

Copilot rolls out best in phases. Phase one: two or three partners plus one associate per practice group, who become internal champions. Phase two: the litigation, transactional, and specialty groups on staggered start dates. Phase three: the full firm, once the champions have documented what works. Support staff belong in phase one on the workflows where they touch matter data most, including paralegals drafting in Word and building damages models in Excel, and legal assistants triaging correspondence in Outlook. As The Florida Bar’s coverage of ABA Formal Opinion 512 explains, the ABA’s July 2024 opinion requires lawyers using generative AI to consider their duties of competence, confidentiality, client communication, supervision, and reasonable fees. Florida Bar Advisory Opinion 24-1, approved in January 2024, concludes that a lawyer may use generative AI only to the extent the lawyer can reasonably guarantee compliance with those obligations, and recommends informed client consent before confidential information is disclosed to a third-party AI program.

Corporate clients with SOC 2 or ISO 27001 programs increasingly ask in vendor questionnaires which AI tools touch their matters and what governance sits behind them, and cyber insurers are starting to ask the same. Microsoft 365 Copilot runs under Microsoft’s enterprise data protection terms; consumer versions of ChatGPT, Claude, and Gemini do not come with those terms and should not receive client data. A firm that has done AI readiness and compliance work has the written policy, approved tools list, and audit trail these conversations require.
